Spyware Law Coming Soon

The House has passed its long awaited spyware legislation, still called SPYACT Act. This new version is much better than previous ones, with much improved definitions and more specific offenses. It contains required language in click-through installation contracts and bans tricks such as a ‘no’ button which installs.
But while the House Energy & Commerce Committee was working on this bill, the Judiciary Committee was working on its own version, ISPY, which includes criminal penalties. This bill has an intent inquiry and vague definitions. There is also a Senate version, SPYBLOCK Act, or better yet SPYBLOCKA. This is similar to the House’s passed version, in spirit at least, and the House version could offer many improvements to it. Both of these other bills should be voted on soon.
Yay – This is for sure some good news for the computing world.
